Mixed File
The most common problem reported with background searches involves mixed files. While this is more likely for people with common names, anyone can find that their personal information is mistakenly combined with someone else’s.
The Fair Credit Reporting Act (FCRA) requires credit reporting agencies like TransUnion, Equifax, and Experian to use the maximum possible accuracy when reporting credit history and activity. This law also obligates them to conduct a reasonable investigation when a consumer disputes an inaccuracy.
If incorrect information appears on a background report and the consumer notifies the reporting bureau, the bureau must investigate free of charge. The agency must then report back the results, and if the information is corrected, they must offer to send an updated report to any person or company that recently received the inaccurate version. If they fail to do so—or ignore your request—you may have the right to recover losses.
